DISPUTE RESOLUTION
While most dealings with friends, acquaintances, neighbours, employers, employees, business partners, businesses themselves, government of any level and even complete strangers end well, occasionally you might find yourself caught in a dispute that you can’t resolve on your own. It might just take a fresh perspective and someone to clearly and objectively state your case to reach that elusive agreement or you might be involved in something much more complex and difficult. Negotiation:
- The first step. Once your position is clearly presented and understood a negotiated agreement is often possible.
Mediation:
- A process where parties to a disagreement that hasn’t been resolved by informal negotiation try to find a mutually agreeable solution to their differences with the help of a trained mediator in a structured setting. I have represented scores of clients in successful mediations.
Arbitration:
- When negotiation hasn’t succeeded and the parties know their differences are such that agreement is not possible, an arbitration conducted pursuant to the Arbitration Act will result in a decision being imposed by a certified arbitrator. I have participated in numerous arbitrations and will do so for you if the situation calls for it.
Litigation:
- The final resort – Court. I have successfully represented countless clients before all levels of court in the Province of Alberta. For example, I have the distinction of having made the winning argument both at trial and at the Alberta Court of Appeal in the case of Fiala v Cechmanek [201 DLR (4th), 680], which has become one of the leading authorities on the civil liability of the mentally disabled in Canada and throughout the British Commonwealth.
